More Rock Stars Suing Activision
No Doubt, you remember them - Gwen Stefani's band, you remember Gwen? - well, they don't like being in Activsion Blizzard's Band Hero. According to reports they are accusing the company of turning them "into a virtual karaoke act."

Like rock'n'roll types they sped around to Activision's offices on Hogs, drinking tequila from the bottle and screaming like banshees demanding justice.

Of course they didn't. Instead, they got some lawyers to file a suit at the Los Angeles Superior Court, a accusing Activision of "fraudulent inducement and breach of contract".

Why?

Well, aside from the band's avatar's being used in other songs, the game sees Ms Stefani singing the Stones' Honky Tonk Woman in avatar form. According to the lawyers, this "results in an unauthorized performance by the Gwen Stefani avatar in a male voice boasting about having sex with prostitutes."

It's all a bit Courtney Love and Kurt Cobain.

It also highlights a legal minefield that - apparently - nobody at Activision or the record labels concerned had noticed was there.

For its part, however, Activision has issued a statement - reported by the LA Times - that states: "Activision believes it is within its legal rights with respect to the use and portrayal of the band members in the game and that this lawsuit is without merit.

Could've been worse, they could've included Suicide Is Painless - M.A.S.H in Guitar Hero 5 and then enabled people to use Kurt Cobain to play it.

To be honest, they seem to be choosing the worst avatars anyway, all these "rock stars" [if you can even call their music rock =/ *pshshhh* ] are under the impression the public enjoy having them in their game, I'd be happy as anything to just go back to the GH1/2/3 days, where they have funky created avatars, without all these namby pamby wanna-be's, with the exception of Ozzy Osbourne and Johnny Cash obviously, they're just too awesome to be in any single music based game.
