A US judge has dismissed a lawsuit brought forward by Fenner Investments Ltd alleging that Nintendo had infringed one of its patents with both Wii and GameCube controllers

Judge Leonard Davis of the U.S. District Court in Tyler, Texas, dismissed the case yesterday without need to go to a jury trial.

Rick Flamm, Nintendo of America’s senior VP, Legal & General Counsel, said, “Nintendo has a long history of developing innovative products while respecting the intellectual property rights of others. We also vigorously defend patent lawsuits when we firmly believe that we have not infringed another party’s patent, despite the risks that this policy entails. I would like to express our sincere appreciation for the tireless efforts of our legal team, which represented us so well.”

Microsoft has not been quite so hardy recently. It just settled a patent infringement case out of court to the tune of $90 million.
